Acceptance of Terms
By accessing or using the Pulsetray website, API, or mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions contained herein, you are strictly prohibited from using the Service. These terms constitute a legally binding agreement between you and Pulsetray.
Modifications to Terms
We reserve the right, at our sole discretion, to change or modify these Terms of Service at any time and without prior notice. Any such changes will be effective immediately upon being posted on our website. Your continued use of the Service following the posting of changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically for updates.
Description of Service
Pulsetray provides a notification infrastructure that allows users to send push notifications to their devices via an API call and view them within a persistent in-app tray. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability to you.
Modification of Plans and Pricing
Pulsetray offers various subscription plans with different features, limits, and pricing. We reserve the right to modify, change, or discontinue any plan, including its price, notification limits, device limits, storage capacity, and feature descriptions, at any time and without prior notice. We shall not be liable to you or to any third party for any modification, price change, or suspension of the Service or its plans.
Account Responsibilities
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials, including API tokens and Onboarding tokens. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Payments and Billing
Payment processing for Pulsetray is handled by Stripe, a third-party payment processor. By subscribing to a paid plan, you agree to provide Stripe with valid payment information and authorize Stripe to charge the applicable fees to your designated payment method. All fees are non-refundable unless otherwise required by law. Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings or the Stripe billing portal.
No Refund Policy
All financial transactions conducted through the Service are final. By subscribing to a paid plan, you acknowledge and agree that all fees are non-refundable, regardless of your usage of the Service or any early termination of your account. We do not provide credits, refunds, or prorated billing for subscriptions that are cancelled mid-cycle or for any unused portions of a subscription plan. We reserve the right, but are not obligated, to evaluate refund requests on a case-by-case basis at our sole discretion.
Communications and Marketing
By creating an account, you provide implicit consent to receive non-marketing communications from Pulsetray. These include, but are not limited to, administrative emails, service announcements, security updates, and news regarding essential changes to the platform. During the onboarding process, you may be asked for explicit permission to receive marketing information and promotional offers. If you provide this permission, we may contact you with marketing materials via email or push notification. You may opt-out of marketing communications at any time through the unsubscribe links provided, but you acknowledge that administrative communications are necessary for the continued operation of your account.
Consent to Receive Notifications
The core purpose of Pulsetray is the delivery and storage of notifications. By installing our mobile applications and using the Service, you provide express consent to receive push notifications on your devices. These notifications may be generated by the account owner (through the use of our API) or sent directly by Pulsetray for the purpose of service alerts, usage limit warnings, or platform updates. You acknowledge that if you disable notification permissions on your device, the primary functionality of the Service will be rendered unavailable, and Pulsetray shall not be liable for any failure to deliver information.
Service Availability and Disclaimer of Warranties
While we strive to provide a reliable and secure experience, Pulsetray is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be entirely uninterrupted, error-free, or available at all times. You acknowledge that access may be temporarily affected by scheduled maintenance, system updates, or technical factors beyond our reasonable control.
Pulsetray disclaims all warranties, whether express or implied, regarding the Service. We do not guarantee that the Service will meet your specific requirements or be suitable for any particular purpose. You agree that your use of the Service is at your own discretion and that we are not responsible for any data loss or delivery failures resulting from service interruptions.
Prohibited Uses
You agree to use Pulsetray only for lawful purposes and in accordance with these Terms. You are solely responsible for the content of all notifications and media attachments (including images, GIFs, and videos) transmitted or stored through the Service. You strictly prohibited from using the Service to upload, post, or distribute any content that is illegal, infringing on third-party intellectual property rights (including copyrighted material), or that contains unauthorized sexually explicit material or pornography that violates applicable laws.
Additionally, all media stored through our infrastructure must comply with the Acceptable Use Policies of our third-party storage and service providers. Other prohibited activities include: sending spam or unsolicited notifications, attempting to interfere with the integrity or security of the API, reverse engineering any part of the Service, or intentionally exceeding rate limits to degrade performance for other users. We reserve the right to immediately remove any content or terminate accounts that we determine, in our sole discretion, to be in violation of these prohibitions.
Limitation of Liability
To the maximum extent permitted by applicable law, Pulsetray and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. This includes any damages resulting from the failure of a notification to be delivered or stored.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Pulsetray and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You retain ownership of the content of the notifications you send, but you grant us a license to store and transmit that content as necessary to provide the Service.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the operator of Pulsetray resides, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
